Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Gravity Engineering Consultancy LLC ("Company," "we," "us," or "our"), a limited liability company registered in Dubai, United Arab Emirates.

By accessing or using our website (www.gravityengineering.ae), engaging our services, or submitting any information through our platforms, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not use our website or services.

Gravity Engineering provides professional engineering consultancy services including:

• Dubai Municipality approval processing and coordination
• Architect of Record (AOR) services
• Structural engineering design and calculations
• MEP (Mechanical, Electrical, Plumbing) design services
• Civil Defence approval coordination
• Authority approval liaison and project management
• Technical consultancy for residential, commercial, and industrial projects

Scope Limitations: Services are limited to those explicitly agreed upon in signed contracts or written proposals. Any work outside the defined scope requires separate agreement and additional fees.

3.1 Quotations

Quotes provided through our website calculator or initial consultations are estimates only. Final pricing will be confirmed in writing based on detailed project assessment. Quotes are valid for 30 days unless otherwise stated.

3.2 Service Agreements

All services require a signed service agreement or engagement letter specifying:

• Scope of work and deliverables
• Fees and payment terms
• Timeline and milestones
• Responsibilities of both parties
• Termination conditions

3.3 Client Responsibilities

Clients must:

• Provide accurate, complete information and documentation
• Respond to requests for information within reasonable timeframes
• Obtain necessary property access and authorizations
• Make timely decisions when required
• Pay invoices according to agreed terms

4.1 Fees

• All fees are quoted in UAE Dirhams (AED) unless otherwise specified
• Fees do not include Dubai Municipality fees, NOC charges, or other third-party costs unless explicitly stated
• Rush processing or expedited services may incur additional charges

4.2 Payment Schedule

Standard payment terms (unless otherwise agreed):

• 50% upon signing service agreement
• 30% upon submission to authorities
• 20% upon approval delivery

4.3 Late Payment

Invoices are due within 7 days of issuance. Late payments may incur a 2% monthly interest charge. We reserve the right to suspend services for accounts overdue by more than 14 days.

4.4 Refunds

Due to the nature of professional services, fees paid are generally non-refundable once work has commenced. Refund requests will be evaluated on a case-by-case basis considering work completed and resources expended.

5.1 Our Property

All content on our website including text, graphics, logos, images, software, and design elements are owned by Gravity Engineering or our licensors and protected by UAE and international intellectual property laws.

5.2 Project Documents

Upon full payment, clients receive a license to use project-specific documents (drawings, calculations, reports) solely for the intended project. We retain ownership of all intellectual property rights. Documents may not be reused for other projects without written permission.

5.3 Portfolio Use

Unless otherwise agreed, we may use project information, photos, and descriptions for marketing, portfolio, and promotional purposes while respecting client confidentiality.

6.1 Professional Standards

We warrant that services will be performed with reasonable care, skill, and diligence consistent with professional engineering standards in Dubai and UAE.

6.2 Approval Success

While we have a strong track record with Dubai Municipality approvals, we cannot guarantee approval outcomes as final decisions rest with government authorities. We are not liable for rejection due to:

• Changes in government regulations or policies
• Incomplete or inaccurate information provided by client
• Site-specific conditions discovered during authority inspection
• Third-party delays (landlords, developers, utility providers)

6.3 Website Disclaimer

Our website and online calculator are provided "as is" without warranties of any kind. Information provided is for general guidance only and does not constitute professional advice for your specific situation.

To the maximum extent permitted by UAE law:

• Our total liability for any claim arising from our services shall not exceed the total fees paid by the client for those services
• We are not liable for indirect, consequential, special, or punitive damages including lost profits, business interruption, or project delays
• We are not liable for damages resulting from client's failure to provide accurate information, follow our advice, or meet their obligations
• Claims must be brought within 12 months of the event giving rise to the claim

Nothing in these Terms limits liability for death, personal injury, fraud, or anything that cannot be excluded by UAE law.

8.1 By Client

Clients may terminate services with 14 days written notice. Client remains liable for:

• All fees for work completed to date of termination
• Reasonable costs incurred for work in progress
• Non-refundable third-party costs paid on client's behalf

8.2 By Company

We may terminate services immediately if:

• Client fails to pay invoices within 30 days of due date
• Client provides false or misleading information
• Client engages in conduct that damages our reputation
• Continuing services would violate applicable laws or regulations

Both parties agree to maintain confidentiality of proprietary information shared during the engagement, except:

• Information required to be disclosed to authorities for approvals
• Information already in public domain
• Disclosure required by law or court order
• General project information for marketing (with client consent)

These Terms are governed by the laws of the United Arab Emirates and the Emirate of Dubai. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

Parties agree to first attempt resolution through good faith negotiation. If unsuccessful, disputes may be referred to mediation before litigation.

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website with an updated "Last Updated" date. Material changes will be communicated via email to registered users.

Continued use of our website or services after changes constitutes acceptance of modified Terms. Existing service contracts remain governed by the Terms in effect at contract signing.

12.1 Entire Agreement

These Terms, together with any signed service agreement and our Privacy Policy, constitute the entire agreement between parties and supersede all prior understandings.

12.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full effect.

12.3 No Waiver

Failure to enforce any provision does not constitute a waiver of that provision or any other provision.

12.4 Assignment

Clients may not assign or transfer their rights under these Terms without our written consent. We may assign our rights to affiliates or successors.

12.5 Force Majeure

Neither party is liable for delays or failures due to circumstances beyond reasonable control including natural disasters, government actions, pandemics, strikes, or utility failures.
